Magnet Baron LLC sells neodymium magnets, magnetization kits, cyanoacrylate adhesives, ferro-magnetic iron PLA filament, 3D-printed mounting components, and related hobby products. These products pose inherent risks, including but not limited to:
- **Choking hazards:** Small magnets and components can be ingested or inhaled.
- **Pinch and crush injuries:** Neodymium magnets are extremely powerful relative to their size and can cause serious pinch or crush injuries to fingers and skin.
- **Interference with medical devices:** Neodymium magnets may interfere with pacemakers, defibrillators, insulin pumps, and other implanted or external medical devices.
- **Ingestion hazards:** If two or more magnets are swallowed, they can attract through intestinal walls and cause serious internal injury or death. This risk is especially acute for children.
- **Adhesive hazards:** Cyanoacrylate adhesives can bond skin and eyes on contact and produce irritating fumes.

(a) You have read and understood the Safety & Warnings page prior to purchase;

(c) You assume full responsibility for the safe handling, use, and storage of all products purchased from this site; and

In no event shall Magnet Baron LLC be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any product purchased through the Service, even if advised of the possibility of such damages.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited by applicable law.

## SECTION 17 — DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER
**PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.**
**Mandatory Binding Arbitration.** You and Magnet Baron LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service or your purchase or use of any product or service from Magnet Baron LLC (collectively, "Disputes") shall be resolved exclusively through final and binding arbitration, rather than in court, except as set forth below. The Federal Arbitration Act, 9 U.S.C. §§ 1–16, governs the interpretation and enforcement of this arbitration provision.
**Arbitration Procedures.** Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, which are available at www.adr.org. The arbitration shall be conducted in Tarrant County, Texas, or, at the claimant's election, by telephone or video conference. The arbitrator shall have exclusive authority to resolve any Dispute, including any claim that all or any part of this arbitration provision is void or voidable. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
**Class Action Waiver.** YOU AND MAGNET BARON LLC AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
**Small Claims Court.** Notwithstanding the foregoing, either party may bring an individual action in small claims court in Tarrant County, Texas, if the claim qualifies under the applicable small claims court rules and jurisdictional limits.
**Exceptions to Arbitration.** Claims for injunctive or equitable relief related to intellectual property infringement or misappropriation may be brought in a court of competent jurisdiction without first submitting to arbitration.
**Opt-Out Right.** You may opt out of this arbitration provision by sending written notice of your decision to opt out to: Magnet Baron LLC, PO Box 92456, Southlake, TX 76092, within thirty (30) days of your first purchase from Magnet Baron LLC. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of this arbitration provision. If you opt out, neither you nor Magnet Baron LLC will be required to arbitrate Disputes, but all other provisions of these Terms of Service will remain in effect.
**Enforceability.** This arbitration provision shall apply to the maximum extent permitted by applicable law. If any portion of this Section is found to be unenforceable as to a particular claim or as to a particular request for relief (such as injunctive relief), that portion shall be severed and the remainder of this Section shall continue to apply.

## SECTION 18 — GOVERNING LAW AND VENUE
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
For any Dispute not subject to arbitration under Section 17, or where arbitration is found unenforceable, you and Magnet Baron LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in Tarrant County, Texas. Both parties consent to personal jurisdiction in Tarrant County, Texas for any such proceedings.
